Start your day with clarity and purpose using AmiroVibe. Designed for breakfast enthusiasts and morning motivators, AmiroVibe helps you:
- Snap and archive your breakfast photos
- Record your thoughts with text notes or voice memos
- Track streaks to stay motivated
- Review past mornings to reflect on progress
3) Account Registration and Responsibilities
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to provide accurate information and keep it updated.
- You are responsible for all activity that occurs under your account.
4) License and Apple Platform Terms
4.1 License to You
Subject to these Terms, AmiroVibe grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own lawful, non-commercial purposes.
4.2 Apple
If you download the Service from Apple’s App Store, you acknowledge that Apple is not a party to these Terms. To the extent required:
- Apple has no obligation to provide maintenance or support for the Service.
- Apple is not responsible for any claims related to the Service.
- Your use must comply with the App Store’s applicable terms and rules.
5) User Content
The Service may allow you to submit or store content such as photos, notes, and voice memos (“User Content”). You retain ownership of your User Content.
You grant AmiroVibe a limited license to host, store, reproduce, and process your User Content solely as necessary to provide, maintain, and improve the Service and to comply with law. This license ends when your User Content is deleted, except for limited backup/retention periods described in our Privacy Policy.
You represent and warrant that you have the rights necessary to upload your User Content and that it does not violate any law or infringe third-party rights.
6) Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, or abusive purposes
- Upload content that is illegal, obscene, or infringes intellectual property or privacy rights
- Attempt to access accounts, data, or systems you are not authorized to access
- Interfere with or disrupt the Service (including by introducing malware or attempting to bypass security)
- Reverse engineer, decompile, or attempt to extract source code, except to the extent allowed by applicable law
7) Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect and use information, how long we retain it, and your choices and rights.
8) Third-Party Services
The Service may interact with third-party services (for example, platform services or device features). We are not responsible for third-party services and your use of them may be governed by their own terms and policies.
9) Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory.
We do not warrant that the Service will be uninterrupted, error-free, or secure.
10) Limitation of Liability
To the fullest extent permitted by law, AmiroVibe and its team members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service.
To the fullest extent permitted by law, AmiroVibe’s total liability for any claim arising out of or related to the Service will not exceed the amount you paid to AmiroVibe for the Service in the 12 months before the event giving rise to the claim (or, if you paid nothing, USD $10).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
11) Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless AmiroVibe from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.
12) Termination
You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms or if necessary to protect the Service, users, or legal compliance.
Upon termination, your license to use the Service ends.
13) Changes to These Terms
We may update these Terms from time to time. We will post the updated version and revise the Effective Date. Your continued use after an update means you accept the updated Terms to the extent permitted by law.
14) Governing Law and Dispute Resolution (Arbitration)
These Terms are governed by the laws of the jurisdiction of our principal place of business, without regard to conflict of law principles.
To the extent permitted by law, any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by final and binding arbitration on an individual basis, rather than in court. The arbitration will be conducted in a manner consistent with applicable law.
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information.
